General Booking Terms and Conditions

"Definitions" of certain words are explained below.

General
"Late Breaks (UK) Limited" or "LateBreaksUK.co.uk" means Late Breaks (UK) Limited with registered number 07643105 at the address of c/o Aberdunant Hall, Prenteg, Porthmadog, Gwynedd, LL49 9SR. Late Breaks (UK) Limited acts as booking agent for the accommodation and other service providers advertised on the website www.latebreaksuk.co.uk (the "Site").

The "holidaymaker" means the person making the booking and includes all persons named or not named who use the accommodation provided by the accommodation provider. By using and/or visiting the Site you agree to these General Terms and Conditions, the Privacy Policy and the Terms of Use and Site Use ("the Terms") and you expressly consent and agree to be bound by the Terms and all applicable laws and regulations that govern this Site and your booking.

"Accommodation providers" means the owner/providers of the static caravans, cottages, lodges, apartments, and other accommodation of any description featured on this website and "accommodation" means the accommodation including all facilities and services offered on our website by the accommodation provider in connection with your confirmed booking.

Important Information for you
Late Breaks (UK) Limited acts as booking agent only and makes bookings on your behalf with the accommodation provider. We undertake no responsibility for and are not liable for the misrepresentations, breaches of contract, breaches of statutory duty or negligence of any of the accommodation providers and other suppliers of services who offer their accommodation for rent or sell their products and services through us. This means that in the event of illness, personal injury or death as a result of any omission or act of an accommodation provider or supplier of services, their agent or employee, or you have any complaint about the quality of the services provided or any complaint at all, your only right of redress will be against the third party that has provided such services and Late Breaks (UK) Limited will be under no liability in any circumstance. This extends to all contracts.
You accept that we have not in any way selected or assembled your travel arrangements for you. Your accommodation arrangements are not a package and do not fall within the meaning of The package Travel, Package Holidays and Package Tours Regulations 1992.

By proceeding to book the accommodation and/or other services through the Site, you accept that you will be entering into a contract with the accommodation provider on their standard terms and conditions. Should they be provided we will attempt (but undertake no liability to do so) to make copies of the accommodation provider's terms and conditions available to you via the Site.

By express understanding you are aware that we may not have checked the quality or suitability of the accommodation providers and we make no representation to the suitability of the accommodation and/or services offered for sale through the Site. Neither does the inclusion or offering for sale of an accommodation and/or service by Late Breaks (UK) Limited constitute an implied or express endorsement or recommendation by Late Breaks (UK) Limited to the accommodation or services offered. In no way do we guarantee the accuracy of the descriptions, images or services listed by the accommodation provider and disclaim total liability for inaccuracies relating to the accommodation or services listed for sale through the Site.

Late Breaks (UK) Limited offers a grading service which is the sole opinion of the accommodation provider and we accept no liability in the accuracy of the noted grading. There is nothing in these terms of use that shall operate to exclude or limit the liability of Late Breaks (UK) Limited for fraudulent misrepresentation or death or personal injury caused by our negligence.

Should you, or any of the people that you are booking on behalf of, be in breach of any of the provisions of these Terms or contravention of any laws or rights of a third party, we reserve the right to cancel your booking without refund or compensation in any way and recover from you any costs incurred as a result of your behavior.

Site content, documentation and booking information.
The Site and/or Terms may be modified by Late Breaks (UK) Limited at any time and such modifications will be effective immediately upon uploading/posting to the Site. By your continued use of the Site you will be deemed to indicate that you have accepted the modified content and/or Terms therein.

Accommodation or details of services provided on the Site including, but without restriction, the details, availability, price, facilities, any awards/accreditations or any other information provided by the accommodation or service provider are the sole opinion of that person/organisation and not that of Late Breaks (UK) Limited and are totally independent to us. These independent organisations or individuals provide services with their own terms and conditions which may limit their liability to you. Late Breaks (UK) Limited are not in any way liable for any omissions, acts or breaches of negligence of any such independent business, organisation or private individual or liable for any damages or expenses in result from the aforementioned. If the accommodation provider overbooks their accommodation or the accommodation becomes unavailable and Late Breaks (UK) Limited have notice before your arrival we are able to refund any monies paid by you. However Late Breaks (UK) Limited are not liable for any refund in the event that the accommodation provider or service provider under force majeure or any other cause beyond the accommodation providers control.

As Late Breaks (UK) Limited acts only as a booking agent we have no responsibility for any errors in any documentation except where those errors were made by Late Breaks (UK) Limited.

Booking your accommodation or other services
You search for your chosen destination and dates, select your preferred accommodation and proceed to the booking process. You should carefully check the dates, price, destination and the accommodation's details before proceeding with your booking are correct.

All bookings are made via the online booking system

To make a booking you will be asked to submit some personal information about yourself including your name, email address, telephone number and payment details hereon referred to as "Personal Information". Whenever you provide such Personal Information, Late Breaks (UK) Limited will collect and use such Personal Information in accordance our "Privacy Policy" which are set out at the end of these Terms. Please read this in full before providing any Personal Information to Late Breaks (UK) Limited.

Booking Confirmation
In order to confirm your booking, you must be authorised to do so by all persons named on the booking. For those that who are under 18 when the booking is made express permission must be provided by their parent or guardian. When you make the booking you are confirming that all persons named on the booking accept the Terms and you will inform the other party members of the booking of the confirmation details. By making a booking you are liable and responsible for making payments due for the booking therein.

Late Breaks (UK) Limited will confirm your booking and issue you with an email confirmation. Late Breaks (UK) Limited will deduct any money due for the booking from your credit/debit card. The accommodation or other service provider with which you enter into a contract will be given payment once your arrival has been confirmed.

Should you call Late Breaks (UK) Limited by telephone, or are called by us regarding your booking those calls may be recorded for training and monitoring purposes. In the event of a dispute regarding a booking, we reserve the right to review any call information.

If you cancel, amend or change a booking
You can amend your booking at any time up to 72 hours before your arrival, or you can cancel your booking up to 48 hours after the booking has been made through the Site.

Should you cancel or amend your booking outside these terms there may be a cancellation charge or an amendment fee applicable which may be levied by the accommodation or service provider. If, in any event, you fail to cancel or amend your booking in accordance with terms you will not be entitled to any refund. Details of the cancellation policy are set are set out in our booking confirmation email at the time of booking and details of the accommodation provider will also be given when you make a booking.

Should you, for whatsoever reason fail to turn up at the accommodation on the arrival date shown on your booking confirmation email and without prior warning to Late Breaks (UK) Limited, this will be classed as a "no show" and shall be considered a cancellation and the aforementioned process will be applied.

Confirmation of age and responsibility
you clearly warrant that you are over the age of 18 years and have the legal capacity to use the Site and to create a legally binding contract.

You also confirm that all personal information that you submit during the booking process are correct and you accept full financial responsibility for any transactions made under your name or online account.

You also authorise Late Breaks (UK) Limited to manage all Personal Information regarding yourself and persons named on the booking that has been obtained at the time of booking.

Any Personal Information that we collect shall be obtained, processed and transmitted in accordance with European Directives 95/46 and 2002/58 as well as any other such legislation that substitutes, complements and develops it. For more detailed information you should refer to our Privacy Policy detailed below.

Travel Arrangements
Late Breaks (UK) Limited do not offer any arrangements regarding your travel to your destination or accommodation provider's location whether this be land, sea or air. Late Breaks (UK) Limited is in no way liable for any damages or losses that may result from travel to any particular destination either in the United Kingdom or elsewhere. For overseas travel The Commonwealth Office helps travelers stay safe. Please review the FCO website at www.fco.gov.uk/knowbeforeyougo for the most up to date information and advice on conditions concerning specific countries.

It is your responsibility to ensure that you have the relevant travel and health documentation prior to departure for the country you are visiting. This shall include, but in no way limited to, any inoculations that may be required, valid passport or identification documents. Late Breaks (UK) Limited shall not be liable for any expense incurred which results from your missing, incomplete or incorrect documentation or any non-compliance with country specific requirements.

International and Domestic Travel Insurance
Late Breaks (UK) Limited strongly advises you to take out adequate travel insurance prior to arriving in your destination. It is your responsibility to check you have adequate insurance cover. The insurance should cover, amongst other things, the cost of cancellation by you, personal losses, all medical costs and the costs of assistance including return to the UK in the event of an accident or illness.

Late Breaks (UK) Limited has partnered with Bakers (Towergate) Insurers and quotes for travel insurance are provided at the time of booking. Cancellation Insurance is automatically added to the Premium Booking Terms. You can remove the Cancellation Insurance by opting for General Booking Conditions at the time of booking.

Force Majeure
Late Breaks (UK) Limited is not be liable for any changes, cancellation or effect on your booking, loss or damage suffered by you or for any failure by the accommodation providers and/or Late Breaks (UK) Limited to perform or properly perform any of our respective obligations to you which is due to any event(s) or circumstance(s) if the non performance is caused by force majeure. By way of example force majeure includes, but is not limited to, war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe or other causes that seriously affect both parties and other unforeseeable causes beyond Late Breaks (UK) Limited's control.

Complaints or issues with your accommodation
In the event that you have a reason to complain or experience any issues with your accommodation you should inform the accommodation provider immediately, to enable them to take appropriate action. You should allow the accommodation provider sufficient time to rectify any issues or problems you experience with the accommodation. The accommodation provider is solely responsible for the accommodation including its availability, description of the accommodation and its location, condition and to ensure that the accommodation is clean, safe and as described at the time of booking and on arrival.

Legislation and Courts of Jurisdiction
This agreement will be governed by English law and any disputes will be dealt with by the English courts. If however you booked your holiday in Scotland or Northern Ireland any disputes may be dealt with in the local courts in Scotland or Northern Ireland and will be subject to the law of those countries.

Late Breaks (UK) Limited Privacy Policy
Late Breaks (UK) Limited is very conscious of what it takes in making purchases online and that it involves your trust and that you wish to remain in control of the personal information you provide. We take this role of protecting your information very seriously. By giving your Personal Information to us either via this Site or by the telephone you consent to the collection, storage and processing of your Personal Information by Late Breaks (UK) Limited as stated in this Privacy Policy.

Should we make any changes to this Privacy Policy they will be made on this page. By your continued use of the Site we will constitute your agreement to the changed Privacy Policy.

When you browse or navigate the Site, we do not collect Personal Information about you and this can only be done when you provide that to us.

Protection of Personal Data
Any Personal Information that Late Breaks (UK) Limited collects from you shall be attained, processed and transmitted in compliance with all applicable data protection legislation. Our servers are only held in the United Kingdom, and therefore the Personal Information that we collect from you shall be obtained, processed and transmitted in compliance with European Directives 95/46 and 2002/58, as well as any other legislation that substitutes, complements and develops it which includes the Personal Data Protection Act within the U.K.

We are very keen to and take full responsibility for ensuring that decent security measures are in place to safeguard your information and keep the information in secure databases at secure addresses to prevent unauthorised access. We have to pass the information on to the relevant accommodation providers of your booking. The information may also be provided to payment gateway providers, public authorities such as customs/immigration if required by them, or as required by law. Our payment gateway provider at this time is Secure Trading and should this alter at any time the information will be updated on this page.

In order to ensure that your booking runs efficiently Late Breaks (UK) Limited needs to your Personal Information such as your name and address, credit card details etc. We will deploy appropriate security measures to protect this data. Late Breaks (UK) Limited may also disclose your Personal Information about you to other organisations that are affiliates or to companies contracted by Late Breaks (UK) Limited to manage aspects of the Site or perform other services connected to the Site on our behalf. LateBreaks (UK) Ltd shall not pass any information onto any person who is not responsible for part of your booking. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements. If we cannot pass this information to the relevant accommodation and/or service providers we cannot provide your booking. In making this booking, you consent to this information being passed onto the relevant persons.

Use of Information
You hereby give consent to allow the use of any data provided to the files of existing personal data held by Late Breaks (UK) Limited and to the treatment of such for the purpose of management, administration, mediation and contracting of the services offered by Late Breaks (UK) Limited, the administration of the booking and the collection of products and services through Late Breaks (UK) Limited, and promotions by means of electronic mail, SMS, MMS or any other similar means, and the subscription to newsletter articles.

You also give consent to permit Late Breaks (UK) Limited to transmit your data for marketing purposes to selected Affiliates but only when you have previously selected the option to "opt in" through the Site. In such cases, Late Breaks (UK) Limited shall only transfer to our Affiliates your adequate, relevant and not excessive personal data (name and email addresses) so you will be able to receive marketing material from our Affiliates related to our Affiliate's or Late Breaks (UK) Limited's products. You have the right to withdraw at any time your consent by being in touch with Late Breaks (UK) Limited, we will stop sending your information. Late Breaks (UK) Limited has no control on the marketing material the Affiliate could send to you therefore Late Breaks (UK) Limited disclaims any liability that may arise from marketing material derived from the Affiliate, being that the Affiliate responsible for that requirement.

Late Breaks (UK) Limited may use your Personal Information to contact you about key alterations to the Site, any new services and with particulars related to other products and services offered by us. Where we collect such material, we will make clear the nature of the information and the purposes for which it will be used. At no point do Late Breaks (UK) Limited knowingly gather Personal Information from children.

Late Breaks (UK) Limited does not automatically subscribe users to our newsletter unless you have bought a service through us or via our Affiliates. In order to receive the newsletter you must opt to subscribe and be informed by email of news and holiday offers. If you would like to unsubscribe from our newsletter at any time, you can advise us via the unsubscribe option which will be detailed on each newsletter.

Accurate reviews of your stay are very important to us. Late Breaks (UK) Limited will use your Personal Information to request you to leave a review after your stay and we will also send you login details to your own area on the Late Breaks (UK) Limited site (called My Booking) which enabled you to access details on your booking and Personal Information.

If you wish to exercise rights of access, rectification, cancellation or opposition you should proceed as follows:
You can find out what Personal Information Late Breaks (UK) Limited holds about you by writing to Late Breaks (UK) Limited. Your request must be accompanied by a cheque for £10.00 which includes any VAT if applicable. We will acknowledge your request within ten (10) working days. Should we be prevented from disclosing your Personal Information we will give reasons for any such refusal. If any of the Personal Information that we hold about you is incorrect or requires updating, please contact us at the above address. Late Breaks (UK) Limited may request that you provide further information and identification to enable Late Breaks (UK) Limited to comply with this request and relevant Data Protection legislation.

Use of 'cookies'
In order to give you the best possible experience when using our Site, Late Breaks (UK) Limited may store some information on your computer. This will be in the form of a "cookie", which will enable Late Breaks (UK) Limited to tailor the Site to match your interests and preferences. The "cookie" is used to store information like the IP address of your machine and will not contain any personal data. In addition to this we utilise a Web Analytics tool which is provided by Google, Inc ("Google"). Google uses cookies which allows them to analyse how visitors use our Site. The information generated by the cookie about the use of our Site (including your IP address) will be transmitted to and stored by Google on servers held in the United States and the United Kingdom. Google will use this information for the purpose of evaluating your use of our Site which will allow us to compile reports on Site activity for Late Breaks (UK) Limited Ltd and providing other services relating to Site activity and Internet usage. Google may also transfer this information to third parties where required to do so by law or where such third parties process the information on Google's behalf. Google. You may refuse the use of cookies by selecting the appropriate settings on your Web Browser, however please note that if you do this you may not be able to make full use of our Site. By using this Site, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

Late Breaks (UK) Limited regard the databases of our Site visitor's information as a valuable asset. Should Late Breaks (UK) Limited sell or delegate any of Late Breaks (UK) Limited's business assets this may include the sale or transferal of such databases of information to third parties. Such a transfer or sale may mean that your Personal Information is transferred to countries outside the European Economic Area (EEA). In using the Site and accepting these terms of use you consent to such use of your Personal Information.

Terms of Use and Site Use

At any time Late Breaks (UK) Limited may suspend or disable access to the Site, due to maintenance requirements, Internet security reasons or force majeure with no obligation to reimburse or compensate you for the period in which access was suspended or disabled.

Access to the Site is strictly controlled by Late Breaks (UK) Limited and we reserve the right to change, modify, substitute, suspend or remove without notice any information or service from time to time.

Should you download a copy of the content of the Site for your own personal use you may not remove any trademark, copyright or other proprietary notice. You may not otherwise copy, modify, reproduce, sell, lease, market or distribute the content available on the Site without the prior written consent of Late Breaks (UK) Limited.

You may only use the Site to make genuine enquiries or bookings for yourself or another person for whom you are legally authorised to act.

You shall not:
• post, broadcast or disseminate any information on or via this Site which is or may be harmful, obscene, defamatory or otherwise illegal, or may cause an infringement of the rights of any other; make any other unauthorised, false or fraudulent booking;
• use any software, routine or device to interfere or attempt to interfere electronically or manually with the operation or functionality of this Site including, but not limited to, uploading or making available files containing corrupt data or viruses via whatever means; deface, alter or interfere with the appearance and layout of this website or the underlying code; take any action that imposes an unreasonable or disproportionately large load on this Site or related technical infrastructure.
Without prejudice to any of Late Breaks (UK) Limited's other rights, Late Breaks (UK) Limited reserves the right to deny access to this Site and/or cancel bookings wherever and whenever Late Breaks (UK) Limited believes, at our discretion, that you are in breach of any of the Late Breaks (UK) Limited Terms.

Links to external sites and downloads
Late Breaks (UK) Limited may, from time to time, provide links (hyperlinks) or pointers to other sites maintained by third parties which Late Breaks (UK) Limited may think are of interest to visitors of the Site. Such other websites are not under the control of Late Breaks (UK) Limited or maintained by Late Breaks (UK) Limited and we are not responsible for the content of such websites. Late Breaks (UK) Limited provides these links for your convenience only but does not monitor or endorse the material on them. Late Breaks (UK) Limited cannot accept any liability whatsoever arising in relation to any such other websites or in relation to any material or information appearing on them or which you may otherwise come across after leaving the Site by way of a hypertext link or any other means or for any services or facilities of any description which you may book through or via any such website.

It is always wise for you to run an anti-virus programme on all content and materials downloaded from the Internet in general and the Site in particular.

At Late Breaks (UK) Limited we take our responsibility for making web content accessible seriously. Late Breaks (UK) Limited is engaged in the on-going process of testing our products and Site for compliance with current accessibility standards. We are working tirelessly to provide services and information that are helpful to all our customers. Some users with disabilities find websites difficult to use because of the way they are designed. This Site has been designed to be as accessible as possible and to be compatible with the types of adaptive equipment used by people with disabilities including screen readers.

Cancellation

Our 'General Booking Terms' includes cancellation insurance if you are forced to cancel your holiday due to a number of qualifying reasons.

You can remove the cancellation insurance at time of booking but in the event of you having to cancel you may be liable for up to 100 % of the holiday costs. Your statutory rights are not affected.

Cancellation terms
Upon receipt of documentary evidence, you will be entitled to a refund for your accommodation (less a £25 administration charge) if you cancel any time after we have accepted your booking and prior to you leaving home to start your Holiday, or you curtail your holiday at any time after you leave home and before your planned departure date or holiday end date (provided that everyone in your entire party cancels or curtails their holiday, and the accommodation is left vacant), and your reason for doing so did not exist at the time of booking or accepting cancellation insurance and is due to any of the following:
• the death, bodily injury, illness or admission to Hospital as an inpatient of you or any other person in your party; a Partner; or a
member of your Immediate Family where the cancellation or curtailment is certified as medically necessary by a Qualified Medical Practitioner,
• compulsory quarantine of any person in your party or their travel being prevented by Government restriction following an epidemic;
• redundancy qualifying for payment under any applicable statute of any person in your party; which is notified to and received by you (or any person in your party) after your upgrade is accepted;

• Hi-jack of an aircraft or conveyance in which you/your party is travelling as a passenger;
• you or a person in your party being required for compulsory jury or witness service in a Court of Law in proceedings to be undertaken in the time between their leaving Home to start the Holiday and returning Home after the Holiday;
• unexpected posting by HM Forces or cancellation of leave by HM Police (unless the cost of the lost trip is recoverable from any other source) or compulsory quarantine;
• Police advising against travel due to adverse weather conditions;
• Police requiring a person in your party to attend following theft at their Home or usual place of business; or
• damage rendering the Home of any person in your party uninhabitable.

The calculation of the amount due is as follows;
• we will refund your balance less the administrative charge (booking terms upgrade, amendment and credit card charges are non refundable).
• if everyone in your party curtails the holiday and returns home, we will give you a proportionate refund of the cost of the
accommodation less the administrative charge (booking terms upgrade, amendment and credit card charges are non refundable). The administrative charge is to cover the costs and charges incurred in the process.

You will not be entitled to any refund or waiver of responsibility for any refund payment due if the cancellation is due to any of the following:
• War, whether declared or not;
• ionising radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste resulting from the combustion of nuclear fuel;
• the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly;
• loss due to devaluation of currency or shortages due to errors or omission during monetary transaction;
• any person in your party deciding not to travel, or if already left Home, deciding not to continue;
• any person in your party's loss of enjoyment of the Holiday;
• any accident to or illness of any person in your party's family pet;
• adverse changes in any person in your party's financial circumstances or unemployment other than redundancy as described above;

If you have upgraded to our 'General Booking Terms' but your reason for cancellation is not listed as a qualifying reason or you are unable to provide sufficient documentary evidence, the charges set out in clause 6 apply.

You will need to let us know immediately that the circumstances arise and provide us with all the information and documentation that we may reasonably require to assess your entitlement to a refund/waiver under the 'General Booking Terms'.

Definitions
• Holiday – any trip involving pre-booked travel or accommodation, devoted entirely to pleasure, rest or relaxation in the United
Kingdom and booked through LatebreaksUK
• Home – usual permanent place of residence.
• Hospital – any establishment which is registered or licensed as a medical or surgical hospital in the country in which it is located and where a person in your party is under the constant supervision of a Qualified Medical Practitioner.
• Hi-jack – unlawful seizure or taking control of an aircraft or conveyance in which a member of your party is travelling.
• Immediate Family – means the Partner, or the child, grandchild, brother, sister, Parent, or grandparent of you or a person in your party, or anyone noted as next of kin on any legal document.
• Parent or Legal Guardian – a person with parental responsibility, or a legal guardian, both being in accordance with the Children Act 1989 and any statutory amendment modification or re-enactment of it.

• Partner – a spouse of, civil partner registered pursuant to the Civil Partnership Act of; or someone of either sex with whom you or a person in your party has been living as though they were their spouse for at least
three months.

• Qualified Medical Practitioner – a doctor or specialist who is registered or licensed to practice medicine under the laws of the country in which they practice other than a person in your party or a relative of any such person, unless approved by Late Breaks UK.
• War – means armed conflict between nations, invasion, act of foreign enemy, civil war, military or usurped power.
27. Cancellation Procedure. If a cancellation or curtailment situation arises for a qualifying reason, please contact us in writing by e-mail or via the Owners club. You will also need to complete a cancellation form which will be supplied and can be downloaded from the Late Breaks UK website www.LateBreaksUK.co.uk/pdfs/2011cancellationform.pdf.
• You and your party must take ordinary and reasonable care to safeguard against loss, damage, accident, injury or illness
• All information provided to us must be complete and accurate
• You must supply the information using our cancellation form
• You will not be paid if you or your party do not comply with any obligation to act in a certain way specified in this clause or if they are dishonest
• All certificates, information and evidence provided by you shall be at your expense.
